Cargofy.com Terms of Use

1. Introduction

These Terms of Use (“Terms”) form a binding agreement between you (“User”) and Cargofy Inc. (“Cargofy,” “we,” “us”). They govern your use of Cargofy.com and its associated services and mobile apps. By creating an account or using our services, you agree to these Terms and our Privacy Policy.

2. Definitions

Platform: Cargofy.com, our mobile apps, APIs, and associated AI tools.
Services: AI-powered freight search, dispatch, trip tracking, load board integration, and communication automation.
User: Any registered company or individual using the platform, including carriers, dispatchers or brokers.

3. Eligibility & Acceptance

You must be 18+ and using the platform on behalf of a business.
By registering, you accept these Terms. If you do not agree, do not use the platform.

4. Services & Usage

We provide access to automation tools including an AI copilot for freight dispatch, communication, and optimization.
You must create an accurate account. You are responsible for maintaining its security.
We grant you a non-transferable license to use the platform. You may not reverse-engineer, scrape, or automate outside our APIs.
Paid plans are subject to your subscription terms. Free trials may be limited.
Mobile app use is subject to the terms of Google Play and the Apple App Store.

5. Compliance & Consent

GDPR: We rely on lawful processing, including consent, contract, and legitimate interest. EU users may exercise data rights as described in our Privacy Policy.
Ukraine & Central Asia: We align with local privacy and data protection laws across these regions.
A2P 10DLC (U.S.): By registering, you consent to receive automated calls and SMS related to dispatch, tracking, and account activity.
EU AI Act: Our platform uses AI for profiling, dispatch automation, and routing suggestions. These features are transparent, optional, and non-binding unless configured otherwise by the user.
App Compliance: Our mobile apps request location data with your explicit consent. This supports freight tracking, and background use is disclosed and encrypted. You may disable location at any time.

6. Data, Privacy & Cookies

We collect business and personal data to provide and improve our services. Full details are in our Privacy Policy.
Cookies and tracking tools are used to improve AI models and performance. You may manage consent preferences via banner tools (EU users).
You are responsible for managing device-level permissions for notifications, camera, microphone, and GPS as required.

7. Intellectual Property

All rights to the platform, AI systems, branding, and backend logic belong to Cargofy Inc.
You may not reuse, resell, white-label, or copy any part of the service unless specifically licensed.
User content (e.g. uploaded data, requests) grants us a limited license for operational use only.

8. Disclaimers & Limitation of Liability

We provide the platform “as is.” We do not guarantee availability, accuracy, or AI suggestions.
Cargofy is not liable for lost revenue, missed freight, or errors made by AI or automation.
You are solely responsible for any business decisions based on data or recommendations provided by the platform.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or abuse the platform.
You may close your account at any time with written notice.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California and applicable U.S. federal and international law.
Users in the EU or Ukraine may benefit from consumer protections and may raise claims in their jurisdiction where applicable.
